These Terms of Service (“Terms”) are an agreement between you and Bonne Vague Ventures, LLC (“Bonne Vague,” “we,” “us”), which operates Pow with Friends, the app for planning mountain days and ski and snowboard trips with friends (the “App”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to use Pow with Friends. If you are under 18, or not old enough to agree to these Terms where you live, you may use the App only with your parent’s or guardian’s permission. They should review these Terms and are responsible for your use of the App. You may not use the App if the law prohibits you from doing so.
2. Your account and sign-in
- Give accurate information when you sign up and keep it current. You are responsible for activity on your account and for keeping your password and devices secure.
- You may sign in with an email and password, or with Apple, Google, Facebook or your Surf with Friends account where offered. Your use of those services is also governed by their own terms.
- Surf with Friends is also operated by Bonne Vague. Connecting it lets you use one identity across both apps, and each app keeps its own account and content.
- Don’t create accounts for other people, sell or transfer your account, or use someone else’s account.
- Tell us right away at info@surfwithfriends.com if you think someone has accessed your account without permission.
3. What Pow with Friends does
Pow with Friends helps skiers and snowboarders:
- connect with friends;
- plan mountain days and trips, including flights, lodging, carpools, activities and shared expenses;
- organize groups and message each other;
- list and find gear;
- see snow and resort information.
Some features are in preview or testing and may change, be limited to some users, or be removed. We may update, change or discontinue parts of the App at any time. The App is free to use today; if we introduce paid features, we will tell you the terms before you are charged.
4. Acceptable use
You agree not to:
- harass, threaten, bully, stalk, impersonate, scam or spam anyone, or share someone’s private information without permission;
- post content that is illegal, hateful, sexually explicit, violent, misleading, or that infringes someone else’s rights;
- create fake accounts, fake mountain days or trips, false RSVPs or misleading listings;
- encourage others to ride closed terrain, trespass, ignore closures or ski patrol, or take unsafe risks;
- misuse reports, blocks, invitations, friend discovery or messaging;
- scrape, copy or harvest data from the App, or use it to build a competing service;
- interfere with, probe or attempt unauthorized access to the App or its systems, or bypass its limits or security;
- use the App for any unlawful purpose.
5. Your content
“Your content” means what you add to the App. That includes profile details, photos, mountain days, trips, notes, comments, messages, listings and reports.
- You keep ownership of your content, and you are responsible for it. Only share content you have the right to share, including photos of other people.
- You give Bonne Vague a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt for display, and show your content. The license lets us operate and improve the App and show your content to the people you share it with. It also lets us sublicense to our service providers for those purposes.
- The license ends when your content is deleted, except:
- for content others still have (such as messages you sent them);
- for copies in backups for a limited time;
- where we must keep it for legal reasons.
- We don’t use your content in advertising.
- We may remove content or limit visibility if we believe it breaks these Terms or puts people at risk. We are not obligated to review content before it is posted.
6. Friends, contacts and invitations
If you use Connect Contacts or Find Facebook friends, you confirm you are allowed to use that information to find people you know. Only send invitations to people who would expect to hear from you. How we handle this information is described in our Privacy Policy.
7. Mountain risk and assumption of risk
Skiing, snowboarding, backcountry travel and mountain trips are dangerous and can result in serious injury or death. Hazards include:
- avalanches, tree wells, cliffs, rocks, ice and changing snow;
- collisions and lift incidents;
- cold, altitude and severe weather;
- winter driving and mountain roads.
Pow with Friends is a planning and social tool. It does not provide instruction, guiding, ski patrol, rescue, avalanche forecasting or emergency services.
You are solely responsible for:
- your decisions, skill level, fitness, equipment and training;
- following resort rules, closures and posted warnings;
- checking official avalanche forecasts before entering avalanche terrain.
To the fullest extent permitted by law, you voluntarily assume all risks of riding, traveling to and from the mountains, and taking part in any mountain day, trip, carpool or meetup arranged through or related to the App. In an emergency, contact local emergency services or ski patrol.
8. Snow, weather and avalanche information
Snow reports, forecasts, weather and avalanche information in the App come from third-party providers and automated models. They may be delayed, incomplete or wrong. This information is for general planning only. It is not a substitute for official avalanche center forecasts, resort reports, or your own on-the-ground judgment. We do not guarantee that any resort, run, route, road or condition is open, safe or as described.
9. Meeting people, trips and carpools
Pow with Friends helps you plan with people and meet them in person. We do not screen users or run background checks, and we make no promises about anyone’s identity, conduct, driving, or ability.
- Use good judgment, especially with people you haven’t met.
- Arrangements between users are solely between those users. That includes carpools, rides, shared lodging, bookings, activities and cost sharing.
- Trip expense tracking is a record-keeping tool. Pow with Friends does not process payments or guarantee that anyone will pay what they owe.
10. Marketplace
The marketplace lets users list and find ski and snowboard gear.
- Bonne Vague is not a party to any sale, and does not process payments or handle shipping.
- We do not inspect gear or verify listings, and we make no guarantees about quality, safety, legality or delivery.
- Sellers are responsible for accurate listings and for complying with the law.
- Buyers should inspect gear, and both sides are responsible for completing transactions safely.
- Don’t list stolen, counterfeit, recalled, unsafe or prohibited items.
11. Reporting, blocking and moderation
Use the App’s report and block tools if someone makes you feel unsafe or breaks these Terms. When content, including a message, is reported, we may review it. We may remove content, restrict features, or suspend or remove accounts to protect the community. We may also cooperate with law enforcement where appropriate.
12. Third-party services
The App relies on third-party services such as Apple, Google, Meta, map and weather providers, and may link to other websites. We are not responsible for third-party services or content, and your use of them is governed by their terms.
13. Disclaimers
The App is provided “as is” and “as available.” To the fullest extent permitted by law, Bonne Vague disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the App will be uninterrupted, secure or error-free, or that any information in it, including conditions, forecasts, trip details or listings, is accurate or reliable.
14. Limitation of liability
To the fullest extent permitted by law, Bonne Vague and its owners, members, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. This applies to claims arising from or related to:
- the App;
- riding or mountain activities;
- travel or carpools;
- meeting or dealing with other users;
- marketplace transactions;
- content in the App.
Our total liability for all claims relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim arose, or US$100. Some places do not allow these limits, so they may not all apply to you.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless Bonne Vague and its owners, members, officers, employees and agents from claims, losses and expenses, including reasonable attorneys’ fees, arising from:
- your use of the App;
- your content;
- your dealings or meetups with other users;
- your violation of these Terms, the law, or anyone’s rights.
16. Copyright complaints
If you believe content in the App infringes your copyright, email info@surfwithfriends.com with:
- the work and the material you believe infringes it, including where it appears in the App;
- your contact details;
- a statement that you believe in good faith the use is not authorized;
- a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner;
- your physical or electronic signature.
We may remove infringing material and terminate repeat infringers.
17. Deleting or suspending accounts
You can delete your account at any time from Profile → Settings → Delete Account; see Data Deletion. We may suspend or remove accounts that break these Terms, create risk for others, or where required by law.
These sections survive after your account ends: 5 (license to content others still have), 7, 8, 9, 10, 13, 14, 15 and 20.
18. Changes to these Terms
We may update these Terms. We will change the date above and, for significant changes, give notice in the App. Changes take effect when posted. If you keep using the App after that, you accept the updated Terms.
19. App stores
If you got the App from Apple’s App Store or Google Play, these Terms are between you and Bonne Vague, not Apple or Google. Apple and Google are not responsible for the App or its support, and your use must also follow the store’s usage rules. To the extent applicable, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
20. General
These Terms, together with our Privacy Policy, are the entire agreement between you and Bonne Vague about the App.
- If any part is found unenforceable, the rest stays in effect.
- Not enforcing a provision is not a waiver of it.
- You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
- We are not responsible for delays or failures caused by events beyond our reasonable control.
- If you have a concern, please contact us first so we can try to resolve it informally.
